In a key smartphone hearing today, Apple is taking on the, now Google owned Motorola Mobility. The lawsuit will be heard today in a Federal Court of Chicago by federal judge Richard Posner, who will decide if few of the Motorola handsets in questions should be banned.

Today’s hearing will be crucial for Apple because if there is a an injunction passed against some of the Motorola handsets, it will help Apple negotiate favorable licensing agreements with Samsung and HTC as well.

Motorola had earlier filed lawsuits against Apple back in October, 2006 to negate any patent lawsuit Apple might file against them. Which Apple did in the same month.

Though Posner ruled out most of Motorola’s claims in pre-trial, he upheld some of the patent claims made by Apple. Eventually, he dismissed the case before its scheduled hearing stating that neither side could prove any damages and citing that banning Motorola’s handsets will be against public interest.

Interestingly, Posner granted Apple’s request to take up the injunction case for hearing last week. And a victory here for Apple today will be a shot in the arm as they prepare to take on Samsung in a scheduled trial for 30th July in San Jose, California.

We will let keep you posted on the developments and the result of the hearing today. Do watch out this space for more info on the same.
