Continuing with the trend of Samsung losing cases against Apple, the latest one we have is from the Netherlands where a court has just ruled against Samsung – refusing to pass an injunction on the sake of Apple products in that country.
The case is a continuation of the same one that the two companies have been bitterly fighting against each other in 10 countries. The court dismissed Samsung’s claim that Apple had infringed upon Samsung’s patents pertaining to various 3G technologies. The court argued that many of the 3G patents that belonged to Samsung were part of essential standards which should be open to license. The court encouraged both the companies to work on a licensing agreement to solve the dispute.
While the ruling sure is a blow to Samsung, all was not well for Apple either with the court dismissing Apple’s counterclaims against Samsung in the case. Experts are of the opinion that with the latest ruling in place, it would be extremely difficult for Samsung to hope for a ban on Apple products in the EU.
Samsung has also filed a new case asking for the ban on the sales of the newest iPhone version – the iPhone 4S in Japan and Australia recently. That basis of that new case however is the same. In Japan, Samsung has asked for a ban citing infringements by Apple on their proprietary technology related to HSPA connectivity. In Australia, the infringememt is claimed on WCDMA and HSPA technology. In Japan there is also a claim by Samsung about Apple infringing upon an UI element that Samsung claims to be owned by it.
It remains to be seen if Samsung manages to garner some success against Apple with that case.
