It’s been barely 24 hours since Apple introduced its fifth generation iPhone and Samsung is already prepping its first lawsuit against Apple. Samsung has issued a statement where it says that they are filing a case against the iPhone 4S to block its sales. The reason? Apple is using Samsung’s WCDMA standards on the iPhone without licensing it from them.
The Statement says; “Apple has continued to flagrantly violate our intellectual property rights and free-ride on our technology. We will steadfastly protect our intellectual property.”
Samsung will file requests asking for injunctions on the sale of the iPhone 4S today in France and Germany – the reason being the fact that these countries allow companies to file an injunction for products that have not yet been launched there. The decision to file this suit against Apple comes close on the heels of the rejection of a “peace offering” by Samsung.
Samsung had offered Apple to reach a compromise on the legal battle that is being waged in Australia which in turn would have let them launch the Galaxy Tab 10.1 in Australia. Anyway, there is no end in sight for this catfight being played out in the public for the past few months.
